Agreement to Terms

These Terms and Conditions (“Terms”) govern your access to and use of Lifestyles Maven, including the Lifestyles Maven website, application, and related services (collectively, the “Service”). The Service is operated and provided by Lifestyles Discovery LLC (“Company,” “we,” “us,” or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Service.

Service Description

Lifestyles Maven is an AI-powered property management platform that helps handle incoming phone calls, routing, tour scheduling, work order creation, and resident or prospect assistance for multifamily properties.

Intellectual Property and License

Lifestyles Maven is operated by Lifestyles Discovery LLC under license from Tiffamon Holdings LLC. All intellectual property rights in Lifestyles Maven, including the software, source code, object code, AI workflows, user interface, designs, documentation, product names, logos, trademarks, service marks, and related materials, are owned by Tiffamon Holdings LLC, except for third-party materials owned by their respective providers.

Subject to your compliance with these Terms, Lifestyles Discovery LLC grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Service solely for your internal business purposes. No ownership rights are transferred to you.

You may not copy, modify, distribute, reverse engineer, decompile, disassemble, resell, sublicense, or create derivative works from the Service except as expressly permitted by these Terms or with prior written consent from Lifestyles Discovery LLC, Tiffamon Holdings LLC, or the applicable third-party provider.

Tiffamon Holdings LLC is an intended third-party beneficiary of all provisions relating to intellectual property ownership, license restrictions, enforcement rights, disclaimers, limitations of liability, and indemnification.

Acceptable Use

You agree not to use the Service for any unlawful purpose, to interfere with the integrity or performance of the Service, to attempt unauthorized access to any part of the Service, or to use the Service to build a competitive product or service.

AI Services and Call Recording

The Service may use artificial intelligence to handle calls and communications. AI-generated responses may be incomplete or inaccurate and should be reviewed by human staff where appropriate. Calls processed through the Service may be recorded for quality assurance, training, service improvement, and operational purposes. You are responsible for complying with applicable call recording, consent, housing, privacy, and communications laws.

Third-Party Services

The Service may integrate with third-party services such as property management systems, communications providers, payment processors, email providers, AI providers, or cloud hosting providers. We are not responsible for third-party services, and your use of third-party services may be governed by separate terms and policies.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIFESTYLES DISCOVERY LLC, TIFFAMON HOLDINGS LLC, AND THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Indemnification

You agree to defend, indemnify, and hold harmless Lifestyles Discovery LLC, Tiffamon Holdings LLC, and their affiliates, officers, directors, employees, agents, licensors, and service providers from and against claims, damages, obligations, losses, liabilities, costs, and expenses arising from your use of the Service, your violation of these Terms, your violation of applicable law, or any data or content you provide to the Service.

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Harris County, Texas.

Changes to These Terms

We may update these Terms from time to time by posting revised Terms. Your continued use of the Service after revised Terms are posted constitutes acceptance of the updated Terms.
